Terms of Service

1. Who we are

Tonk is a community platform for sharing, discovering, and responding to short sound fragments. It is operated by Lucien Montandon, an individual based in Switzerland ("we", "us", "our"). By creating an account or using Tonk, you agree to these Terms of Service. If you do not agree, please do not use the platform.

2. Your account

• You must be at least 16 years old to create an account.
• You are responsible for keeping your login credentials secure.
• You are responsible for everything that happens under your account.
• We reserve the right to suspend or delete accounts that violate these terms.

3. Uploading content

When you post content to Tonk, including browser recordings and drawings posted as responses to sounds, you confirm that:

• You are the original creator of the content, or you have explicit permission from the rights holder.
• Audio content does not contain third-party music, samples, or recognisable voices of other people without consent.
• Drawings do not reproduce copyrighted characters, logos, or artworks without permission.
• The content does not violate applicable laws or the rights of any third party.

If you post content that violates these rules, you are solely responsible for any legal consequences.

4. Licenses you grant

By uploading a sound, you grant Tonk a non-exclusive, worldwide, royalty-free licence to host, store, display, and stream your sound for the purpose of operating the platform. This does not mean we own your sound. You keep full ownership.

You also choose how other users may use your sound at upload time:

• Anyone can use it: CC BY 4.0. Others may download, use, and remix it, including commercially, as long as they credit you.
• Personal use only, not for profit: CC BY-NC 4.0. Others may download, use, and remix it for non-commercial purposes only, as long as they credit you.

5. Downloading and using sounds

When you download a sound from Tonk, you agree to respect the license chosen by the uploader, credit the original creator where required, and not use a sound beyond the permissions granted by its license.

6. Prohibited content

• Illegal content under Swiss law or the laws of your country.
• Hateful, threatening, or harassing content.
• Content that infringes copyright, trademark, or other intellectual property rights.
• Personal data of others without their consent.

7. Copyright infringement and takedown requests

If you believe a sound or drawing on Tonk infringes your copyright, contact us at takedown@tonk-app.com. Include a description of the work, a link to the specific content, your contact details, and a good-faith statement that the use is not authorised.

8. Disclaimer and liability

Tonk is provided "as is", without warranty of any kind. To the fullest extent permitted by law, Lucien Montandon shall not be liable for indirect, incidental, or consequential damages arising out of your use of Tonk.

9. Governing law

These terms are governed by Swiss law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.
